Terms of Service
These Terms of Service explain the basis on which NebulaWeb provides website design, hosting, maintenance and SEO services.
These Terms of Service apply when you use the NebulaWeb website, submit an enquiry or engage NebulaWeb to provide services.
By using our website or requesting services, you agree to these terms.
About NebulaWeb
NebulaWeb provides website design, website hosting, website maintenance and SEO services to businesses and individuals.
NebulaWeb is a sole trader business name and is not a limited company.
Enquiries and quotations
Submitting an enquiry through the website does not create a contract between you and NebulaWeb.
After reviewing your enquiry, we may provide a quotation, proposal or recommendation.
Unless otherwise stated, quotations are valid for 30 days from the date issued.
Website projects
Website projects normally begin once:
- The proposal or quotation has been accepted
- The required deposit has been paid
- Any required project information has been provided
The client is responsible for providing accurate information, content, images, branding materials and feedback within reasonable timescales.
Payment terms
Unless agreed otherwise, payment terms are as follows:
Projects under £1,500:
- 50% deposit before work begins
- 50% balance before launch or transfer of the website
Projects over £1,500:
- 40% deposit before work begins
- 40% after design approval
- 20% before launch or transfer of the website
NebulaWeb may pause work where payments are overdue.
The final balance must be paid before the website is launched, transferred or made fully available to the client.
Hosting services
Hosting services are optional unless specifically included in a proposal.
Hosting is normally billed monthly in advance unless otherwise agreed.
If hosting payments are not made, NebulaWeb may suspend hosting services after reasonable notice.
The client remains responsible for ensuring their domain name, email services and other third-party services remain active unless NebulaWeb has agreed to manage them.
Maintenance services
Maintenance services are optional and only include the tasks described in the selected maintenance package or agreed proposal.
Maintenance may include content updates, small changes, backups, performance checks, security updates or other agreed support.
Additional work outside the agreed maintenance package may be quoted separately.
SEO services
SEO services may include technical improvements, on-page optimisation, keyword guidance, content recommendations and Google Business Profile support.
NebulaWeb does not guarantee specific rankings, traffic levels or enquiry volumes, as search engine results depend on many factors outside our control.
Client responsibilities
The client agrees to:
- Provide accurate information
- Supply content, images and materials when requested
- Confirm they have permission to use any supplied content, logos or images
- Review work and provide feedback within reasonable timescales
- Make payments when due
- Avoid sending passwords or sensitive login details through unsecured forms or emails
Content and copyright
The client is responsible for ensuring that any content, images, logos, fonts or materials they provide can legally be used on their website.
NebulaWeb is not responsible for copyright issues caused by materials supplied by the client.
Ownership
Unless agreed otherwise, ownership of the completed website transfers to the client once all invoices relating to the project have been paid in full.
NebulaWeb may retain ownership of reusable code, templates, systems, processes and know-how used to create websites.
Third-party tools and services
Websites may rely on third-party services such as hosting providers, analytics tools, form providers, email services, plugins or integrations.
NebulaWeb is not responsible for outages, pricing changes, policy changes or failures caused by third-party providers.
Project delays
If a project is delayed because the client has not supplied required information, content, feedback or payment, timelines may be extended.
Where a project is inactive for a significant period, NebulaWeb may need to revise the timeline or provide a new quotation for further work.
Cancellations
If a client cancels a project after work has started, the deposit may be retained to cover time already spent.
Any additional refund or payment due will depend on the amount of work completed at the time of cancellation.
Limitation of liability
NebulaWeb aims to provide reliable and professional services, but we are not liable for indirect losses, loss of profits, loss of business, loss of data or issues caused by third-party services.
Nothing in these terms excludes liability where it would be unlawful to do so.
Changes to these terms
NebulaWeb may update these Terms of Service from time to time.
The latest version will be published on this website.
